Overview

A regional snack brand discovered a competitor selling products in packaging that closely resembled its own color scheme and layout. Retail buyers had started confusing the two lines. Two regional chains had already placed orders with the wrong company.

The client wanted the confusion to stop without a drawn-out lawsuit during its busiest season, and it wanted to keep a working relationship with a company it met at trade shows every year.

Results

We documented the brand’s history and market recognition, sent a measured demand letter and opened settlement talks. The parties agreed to a transition period and a license covering existing inventory. Talks took three weeks.

The competitor redesigned its packaging, and both companies avoided the cost and delay of litigation. The transition period gave retailers time to clear existing stock. No filing was ever made.

Legal Outcome

The license value shown reflects the negotiated terms of the settlement, not a court award or a fee.

  • Evidence file documenting brand history, sales channels and retailer confusion
  • Measured demand letter followed by a short, structured settlement negotiation
  • Transition license covering existing inventory through the busy season

Conclusion

Not every dispute needs a courtroom. A clear record of the brand’s history and a practical offer gave both sides a way forward that protected their customer relationships.

The client also filed federal registrations for its packaging elements to strengthen its position going forward, so any future question starts from a registered right.

Illustrative matters for a fictional firm. Figures show deal or license value, not fees or court awards. Past results do not predict future outcomes.
