The short answer
California uses pure comparative fault. If you were partly responsible, your compensation is reduced by your share, but you can still recover the rest, even if your share is large. The percentage itself is open to argument.
How does the reduction work?
Suppose a claim is worth $100,000 and you are found 20 percent responsible. You recover $80,000. The math is simple. The fight is almost always over the percentage, because every point is worth real money.

Why is the percentage arguable?
Adjusters often open with a high number for you: you were speeding, you were distracted, you should have seen them. Evidence moves that number, which is why gathering it early matters.
Evidence that lowers your share
- Photos of the scene before anything moved
- Signal timing and camera footage
- Witness names taken at the scene
What raises it
- Apologising or guessing at fault
- A long delay before photos
- Social media posts about the day
Which arguments come up most?
| Argument | Where it has limits |
|---|---|
| No seatbelt | Only affects injuries a belt would have prevented |
| Crossing mid-block | Drivers still owe care to people in the road |
| Riding without lights | Matters at night, far less in daylight |
| Looking at a phone | Must be shown, not assumed |
Admitting you were not perfect is not the same as admitting you caused the crash.
How does California compare with other states?

Some states bar recovery entirely once you are 50 or 51 percent at fault. California does not. Even a majority share leaves a remainder you can claim, which is why it is worth a call even when you think the crash was mostly yours.
What should you do at the scene?
- 01
Photograph before anything moves
Vehicles, skid marks, signals and the view each driver had.
- 02
Ask about cameras
Nearby businesses often overwrite footage within days.
- 03
Take names
Witnesses leave quickly. A phone number is enough.
- 04
Keep to facts
Describe what happened. Do not apologise or guess at fault.
What else do people ask about this?
If I was mostly at fault, is it still worth calling?
Possibly. Under pure comparative fault even a large share leaves something recoverable, and the share may be lower than you think.
Who decides the percentage?
The two sides negotiate it. If the case is tried, a jury decides.
Does the other driver's ticket settle fault?
It helps, but it is not the final word. Fault in a civil claim is decided on all the evidence.
Can both drivers be partly at fault?
Yes, and that is common. Each share is weighed separately.
