The call that sets the tone

The short answer

The first call from the other driver's insurer is recorded and built to fix your account early, while you still feel fine. Be polite, give your contact details and the claim number, and leave fault, speed and symptoms for later.

Why does the adjuster call so quickly?

Adjusters are measured on how fast and how cheaply they close files. A warm, early conversation is the lowest cost way to do both. If you describe your pain as minor on day two, that sentence can be quoted back to you on day two hundred.

Giving contact details is courtesy, not cooperation. Anything about fault or symptoms can wait until a doctor has seen you and, if you choose, a lawyer has too.

Is the friendly tone a trick?

Being polite on the phone and agreeing to be recorded are two very different things.

Not exactly. The adjuster is usually a decent person doing a job, and the job is to protect their employer's money. Kindness is how the call works. It is not a sign they are on your side.

Most people do, and it rarely sinks a claim. Note what you remember saying, then let whoever represents you deal with the adjuster from here. Early words can be put in context by the medical records that come later.

Do I have to talk to the other driver's insurer?

Generally no. You have no contract with them. Your own policy may require you to report the crash to your own insurer.

Will refusing to be recorded hurt my claim?

Declining a recorded statement is common and does not by itself reduce what a claim is worth.

Can I just send them my medical bills?

You can, but bills usually come with a request for a broad records release. Ask for advice before you sign anything that opens your whole medical history.

How do I stop the calls?

Once you have a lawyer, tell the adjuster to contact your representative. The calls then go to the firm instead of your phone.
